4. Accept Terms and Conditions


1 Definitions

Closing Date: T.B.C

Competition: the Competition operated by the Promoter to which these Terms and Conditions apply, wherein the Entrants submit Entries to qualify for a chance to win the Prize;

Contact Details: the contact details provided by the Entrants in accordance with paragraph 2.4;

Entry Fee: £20:00 (twenty pounds sterling) for each Entry;

Entrant: any person who enters the Competition;

Entry: answers submitted to the Questions by the Entrant to obtain an opportunity to win the Prize;

Minimum Number of Entries: 6,000 (six thousand);

Prize: New Coachbuilt Horsebox mounted on a Brand New Euro Cargo 75e16s - 7.5 tonne. Fitted to our "Blenheim" Full Luxury Specification.

Promoter: A.B.I. Horseboxes Limited (company number: 04657343) whose registered office is at 36 Kilcoby Avenue, Agecroft Hall, Pendlebury, Swinton, Manchester M27 8AD, England;

Questions: the questions which the Entrants must answer correctly (substantially in accordance with the relevant answers held by the Promoter) to obtain an opportunity to win the Prize;

Winner: the Entrant chosen at random in accordance with paragraph 4.4 (or, if applicable, paragraph 4.7 or 5.5) on or after the Closing Date who will receive the Prize in accordance with these Terms and Conditions.

2 Eligibility of Entrants

2.1 By entering or attempting to enter the Competition, Entrants are deemed to have read and accepted these Terms and Conditions and agree to be bound by them.

2.2 The Competition is open for entry to all persons aged 18 or over who are resident in the United Kingdom, European and EEC bound countries, Australia and New Zealand, excluding the Promoter, its agents, employees, professional advisers (and the families of such persons) or anyone else connected with the development or operation of the Website or conduct or administration of the Competition in any way.

2.3 Entrants must have a valid email address in order to enter the Competition, details of which must be provided in accordance with paragraph 2.4.

2.4 All Entrants must provide with each Entry full details of their name, address, telephone number and email address by completing the form provided by the Promoter.

2.5 All Entrants are solely responsible for providing the Promoter with accurate and current contact details. The Promoter will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the Contact Details or otherwise.

2.6 Each Entry made by an Entrant will only be valid if:
(a) all of the Questions are answered;
(b) the Entrant's answers to the Questions are clearly marked on the entry form and in an unequivocal manner;
(c) the Entrant completes all of the Contact Details (including a valid email address) in the manner referred to in paragraph 2.4 in a clear and legible manner; and
(d) the Entry Fee is received by the Promoter (in pounds sterling) in cleared funds in accordance with paragraph 3.4 or 3.5 (as the case may be).

2.7 An Entry or attempted Entry shall be declared void (without any refund being given) if the entrant engages in:
(a) any form of fraud; or
(b) hacking or interference with the proper functioning of the Website.

3 Operation of the Competition

3.1 The Competition is operated by the Promoter.

3.2 The Entrants recognise that the Competition is a Prize Competition for the purposes of, inter alia, section 14(5) of the Gambling Act 2005 and that to be eligible for a chance to win the Prize by answering the Questions correctly depends to a substantial degree on the exercise of the skill, judgment and knowledge of the Entrants and that the Prize is not allocated wholly by chance.

3.3 Only valid Entries in accordance with paragraph 2 will be entered into the Competition.

3.4 Save as provided in paragraph 3.5, payment of the Entry Fee may be made in cash, by cheque or by direct bank transfer or by any other means (such as debit card) which may be permitted by the Promoter (in its absolute discretion) from time to time.

3.5 Unless otherwise agreed by the Promoter (in its absolute discretion), payment of the Entry Fee may only be made in cash during the 7 day period prior to (and including) the Closing Date.

3.6 No Entries shall be permitted after the Closing Date.

3.7 Only Entries which have correctly answered the Questions shall be eligible for entry into the draw to win the Prize.

3.8 Payment of the Entry Fee and submission of a valid entry into the Competition does not guarantee in any way that Entrants will win the Prize.

3.9 There is no limit to the number of Entries that any one person can make to the Competition.

3.10 There will be just one Winner of the Prize. There will be no cash alternative to the Prize.

3.11 All Entries will become the property of the Promoter on receipt and will not be returned.

3.12 All Entries or attempted entries to the Competition (including Entries which are not valid under paragraph 2) are final and, except as provided in paragraph 6.3(d), no refund of the Entry Fee shall be made at any time.

3.13 Entrants will receive part of their Entry Form as a receipt of Entry into the Competition (or, in respect of Entries submitted via the Website, Entrants will receive an email from the Promoter containing their ticket number within 2 days of their Entry into the Competition as confirmation that their Entry has been received).

4 Closing Date and Winner

4.1 Subject to paragraph 4.2, the draw to determine the Winner will take place in December 2009 at the Olympia Horse Show.

4.2 If the Minimum Number of Entries has not been reached by the date specified in paragraph 4.1, the Promoter may extend the Closing Date for the Competition (and change the venue at which the draw will be made on such alternative date) by giving notice in accordance with paragraph 4.3. Existing Entrants will also be notified by email of such extension and change of venue.

4.3 Notice under paragraph 4.2 of any extension of the Closing Date and of any change of the venue at which the draw will be made will be given as follows:
(a) where the Promoter (acting reasonably) determines in sufficient time before the date specified in paragraph 4.1 whether or not the Minimum Number of Entries is likely to be reached, the Promoter may give notice in advance of such date on the Website and on the Horsequest website (www.horsequest.co.uk) and in the following publications: Horsedeals Magazine, Horse and Hound; or
(b) where the Promoter (acting reasonably) is unable to determine in sufficient time before such date that the Minimum Number of Entries will not be (or has not been) reached, then the Promoter may on such date make an announcement at the venue referred to in paragraph 4.1, but shall subsequently publish notices on the basis referred to in paragraph 4.3(a).

4.4 The Winner will be the Entrant whose details are randomly drawn before an audience and members of the press at the venue referred to in paragraph 4.1 (or the alternative venue notified by the Promoter in accordance with paragraph 4.2).

4.5 The Winner will be contacted by the Promoter using the Contact Details within 30 days of the Closing Date and will be required to provide a copy of their passport, driving licence or birth certificate to the Promoter to prove their identity.

4.6 The Promoter will also announce the Winner publicly within 24 hours of the Closing Date by posting details of the name and town of residence of the Winner on the Website and by publishing such details on the Horsequest website (www.horsequest.co.uk) and in Horsedeals magazine or such other equine based magazine of the Promoter's choice.

4.7 If the Winner cannot:
(a) be contacted by the Promoter using the Contact Details within 30 days of the Closing Date; or
(b) prove their identity to the reasonable satisfaction of the Promoter, then the Winner shall forfeit the Prize and an alternative Winner shall be selected by drawing details of another Entrant at random.

4.8 The Promoter's decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner pursuant to these Terms and Conditions.

5 The Prize

5.1 Any value specified by the Promoter for the Prize is a statement of the typical retail asking price for an item of its nature and similar specification. The Promoter does not in any way guarantee the value of the Prize or its suitability for any particular purpose or requirements of the Winner.

5.2 The Prize awarded to the Winner may not be the same horsebox which is the Promoter may display from time to time at certain events in connection with promotion of the Competition. The Promoter reserves the right to supply a Prize which is of the same value and specification as the horsebox on display, however variations in colour and other minor details may occur.

5.3 The Promoter shall arrange and pay for the first 12 month's road fund licence for the vehicle which comprises the Prize.

5.4 Save as provided in paragraph 5.3, the Winner is solely responsible for obtaining all relevant licences, permissions and insurances necessary for the ownership and/or use of the vehicle which comprises the Prize (including a valid drivers' licence for the relevant category of vehicle and relevant insurance).

5.5 It will be the responsibility of the Winner to arrange for collection of the Prize from the Promoter at Unit 4, Westlink Business Park, James Corbett Road, Off Eccles New Road, Eccles, Manchester, M50 1EW, England. Collection must take place within 30 days of being notified by the Promoter (using the Contact Details) that they have won the Prize. Failure to do so will mean that the Winner forfeits the Prize and an alternative Winner shall be selected by drawing details of another Entrant at random.

5.6 Further details in relation to the Prize can be found on the Website.

6 Cancellation of the Competition

6.1 The Promoter may cancel the Competition at any time if required to do so by law or by any regulatory authority or if it considers it prudent to do so in light of any enquires made by any regulatory authority in connection with the Competition.

6.2 If the number of Entries at the Closing Date is less than the Minimum Number of Entries, then (subject to paragraph 4.2), the Competition will be cancelled.

6.3 In the event of any cancellation in accordance with paragraph 6.1 or 6.2:
(a) the Promoter shall notify the Entrants by email as soon as reasonably practicable;
(b) the Promoter shall as soon as reasonably practicable give notice of such cancellation on the Website and on the Horsequest website (www.horsequest.co.uk) and in the following publications: Horsedeals Magazine, Horse and Hound; and
(c) the Promoter will be entitled to retain 25% of all Entry Fees to cover administration and marketing expenditure in connection with the Competition; and
(d) subject to paragraph 6.5, the remaining balance of the Entry Fees (75%) will be refunded to the Entrants (in accordance with the number of Entries made by each Entrant) as soon as reasonably practicable after cancellation of the Competition.

6.4 Refunds made pursuant to paragraph 6.3(d) shall be made by cheque or (where the Promoter can identify the relevant Entrant's bank details from the Entrant's payment of the Entry Fee or from other information provided by the Entrant) by BACS transfer or (where payment of the Entry Fee was made by debit card) by refund directly to such card. Where several Entries have been made by an Entrant, the refund will be made in one combined payment.

6.5 Where the Promoter is unable to provide refunds for any reason (including, for example, where the relevant Contact Details are not up to date and/or attempted refunds are returned unpaid), then:
(a) the relevant Entrant shall, with effect from the expiry of 60 days following such attempted refund, forfeit the rights to any refund; and
(b) the Promoter shall as soon as reasonably practicable thereafter donate the amount of the relevant refund to an equine based charity of the Promoter's choice.

6.6 The Promoter's sole liability for any cancellation of the Competition will be to make refunds in accordance with the foregoing provisions of this paragraph 6 and the Promoter shall have no further liability to the Entrant or to any other person in respect of such cancellation.

7 Use of Personal Information

7.1 The Promoter may use the Contact Details and other relevant information provided by the Entrants to the Promoter for the following purposes:
(a) to administer the Competition in accordance with these Terms and Conditions (including, where paragraph 6 applies, to contact the Entrants to facilitate a refund of their Entry Fee);
(b) where relevant, to notify the Winner that they have won the Prize; and
(c) where relevant, to publicise the Winner's name and town of residence.

7.2 The Promoter may also (either by choice or at the request of a third party) also disclose the Contact Details and other relevant information provided by the Entrants to the Promoter to relevant third parties for the purposes set out in paragraph 7.1 and/or for the prevention or investigation of fraud and/or for legal reasons.

8 General

8.1 All Entry Fees will be maintained in a separate, designated bank account by the Promoter until the Closing Date or (where the Competition is cancelled in accordance with paragraph 6) until all refunds have been made and/or donated to charity in accordance with paragraphs 6.3(d) and 6.5.

8.2 Except for death or personal injury or for fraudulent misrepresentation, the Promoter and its agents and representatives will not be liable for any loss (including economic loss) suffered by any person as a result of any act or omission of the Promoter in developing, planning and administrating the Competition and providing the Prize.

8.3 The Promoter does not guarantee the availability of the Website or any page connected thereto and will not be liable for any inability of any person to participate in the Competition because of unavailability of the Website or any page connected thereto. The Promoter also does not accept responsibility for attempted entries which it does not receive due to failures in computer systems, other malfunctions, unavailability or slow performance of servers or any other reason. It is the responsibility of Entrants to contact the Promoter if they do not receive the confirmation email referred to in paragraph 3.13 within the period set out in that paragraph.

8.4 Each Entrant should retain for their future reference a copy of these Terms and Conditions and a copy of the confirmatory email or receipt referred to in paragraph

8.5 3.13.These Terms and Conditions, the Competition, its promotion and administration and all associated activities are governed by English law.
